The 3-Book Publishing Accelerator is a personalised publishing service. Unlike a standard digital product, substantial individual work may be undertaken specifically for each participant, including consultation, manuscript assessment, book development, editing, design, formatting and publishing preparation.
This policy explains what happens if you wish to cancel after purchasing the programme.
1. Your statutory rights
Nothing in this policy is intended to restrict or remove any rights you have under applicable consumer law.
Where you purchase our services online as a consumer, statutory cancellation rights may apply. We will provide the information required concerning those rights as part of the purchasing/onboarding process.
Your statutory rights are not affected by this policy.
2. Starting work during the cancellation period
Because the Accelerator is designed as an intensive programme, you may want us to begin working on your project shortly after you enrol.
Where required, we will ask you to expressly request that Florence J.P. Publishing Studio begins providing the service during your statutory cancellation period.
If you make that request and subsequently exercise a statutory right to cancel after work has started, you may be required to pay an amount proportionate to the services already supplied up to the point at which you informed us of your cancellation. This may include personalised work already undertaken on your project.
Current UK regulations specifically provide for proportionate payment for services supplied during the cancellation period where the consumer requested an early start.
3. Before personalised work begins
If you wish to cancel before personalised work has begun, contact us as soon as possible. Where you are legally entitled to cancel and receive a refund, we will process the refund in accordance with your statutory rights.
4. After personalised work has begun
The Accelerator involves work created specifically for you. This may include:
- Onboarding and strategy consultations
- Manuscript assessment and review
- Book planning and development
- Editing or rewriting work
- Research undertaken specifically for your books
- Cover concepts and cover design
- Interior formatting and layout
- Production of publishing files
- Revisions
- Publishing preparation
- Other personalised services agreed with you
If you cancel after work has begun, any refund or amount payable will be assessed according to your legal rights and the circumstances at the date of cancellation, including the work already completed. We will not impose an arbitrary penalty simply because you cancel.
Where permitted by law, however, Florence J.P. Publishing Studio may charge or retain an amount that fairly reflects services already provided and losses or costs reasonably resulting from the cancellation.
This is important because UK CMA guidance warns businesses against blanket terms saying all advance payments are automatically non-refundable. Amounts retained following cancellation should reasonably reflect the business's actual losses rather than operate as a disproportionate penalty.
5. Completed personalised work
If an agreed service or stage of work has already been fully completed, the fact that you subsequently decide not to use that work does not automatically mean that you are entitled to a refund for the completed service. Any statutory rights you may have remain unaffected.
6. If there is a problem with our service
This cancellation policy does not remove your rights where Florence J.P. Publishing Studio has failed to provide services in accordance with applicable consumer law or the agreement made with you.
If you believe there is a problem with work we have provided, please contact us first and give us a reasonable opportunity to investigate and, where appropriate, put matters right.
7. Change of mind is different from dissatisfaction with the service
A customer's decision to abandon a book, change publishing plans, delay publication or no longer wish to continue is not necessarily the same as Florence J.P. Publishing Studio failing to provide the contracted service.
However, every cancellation request will be considered fairly and in accordance with this policy and applicable consumer law.
8. Refund calculations
Where a partial refund is appropriate, we will explain how it has been calculated. Depending upon the circumstances, this may take into account:
− the fair value of services already supplied
− other reasonable and legally recoverable losses directly resulting from cancellation
= refund due
We will not charge twice for the same loss. CMA guidance specifically warns businesses against recovering the same loss through both retained advance payments and additional cancellation charges.
9. How to cancel
To request cancellation, contact info@florencejpenn.com and include:
- Your full name
- Email address used when purchasing
- Date of purchase
- Programme purchased
- Your request to cancel
We will acknowledge your request and explain the next steps.
10. Refund method
Where a refund is due, it will normally be returned using the original payment method, subject to applicable payment-provider procedures and legal requirements.
11. Digital products and files
The Accelerator may also involve digital materials or digital content. Different cancellation rules can apply where digital content is supplied immediately. For qualifying digital downloads, UK guidance says the customer must expressly agree to immediate supply and acknowledge the resulting effect on the statutory cancellation right before the download begins. Where relevant, appropriate consent will therefore be obtained separately.
12. Fairness and transparency
Our aim is to protect both our clients and the work invested in their projects. We will not use this policy to impose disproportionate cancellation charges or automatically retain substantial payments where doing so would be unfair.
Likewise, where significant personalised work has already been properly performed, the calculation of any refund may fairly reflect that work.
